Simon J's story

Unite Legal Services has secured compensation for Simon J* who is employed in the food production industry after he was injured at work. 

The member was pressure washing the production floor with a water jet when he tripped over a metal drain cover. The drain cover had been left against a wall in the area where he was required to work and it was not easily visible due to the steam and water spray of the pressure washer. 

He fell to the ground and suffered a severe ankle sprain and swelling. This affected his usual sporting activities and gym training, and he was unable to return to his normal work duties for approximately six weeks. 

The employer had a duty to ensure that the floor in the workplace was free from obstructions. Had a proper procedure been in place, the drain cover would not have been left in such a way as to cause the member to trip. 

The defendants denied liability, saying that the drain cover was clearly visible, and even suggested that the member had placed it there himself. With Unite Legal Services backing, court proceedings were issued and the defendants settled the plaintiff’s case at trial.
